Marketing and Promotional Terms

1. About these terms
1.1 These Marketing and Promotional Terms ("Marketing Terms") govern all promotional offers, incentive programmes, and time-limited deals offered by Get Dizzy AI ("Get Dizzy", "we", "us", "our"), operated by Get Dizzy AI LTD, a company registered in England and Wales (company number 17045871), with its registered office at 340 The Crescent, Colchester, England, CO4 9AD. Venue Partner incentive programmes (including Win a Free Month, Get Dizzy Exclusive Credit, and any future partner referral programme) are governed primarily by the Venue Partner Terms and Conditions, with supplementary detail provided here.
1.2 These Marketing Terms apply to consumers, Venue Partners, and any other participants in Get Dizzy promotional programmes. They should be read alongside the Consumer Terms of Service (for consumers) and the Venue Partner Terms and Conditions (for Venue Partners).
1.3 Where these Marketing Terms conflict with the Consumer Terms of Service or Venue Partner Terms and Conditions, the relevant terms of service take precedence.
1.4 By participating in any promotional offer or incentive programme, you agree to these Marketing Terms.
1.5 Marketing communications (such as emails about new features, promotions, or partner tips) are governed by our Privacy Policy and your marketing preferences. You can opt out of marketing communications at any time using the unsubscribe link in any marketing email or through your account settings. Opting out of marketing does not affect service messages about your subscription, account, or programme administration, which we may continue to send. Participation in any promotional programme does not require you to opt in to marketing communications.
2. General rules for all promotions
2.1 Unless stated otherwise, all promotional offers and incentive programmes:
(a) are available only in the UK and may be restricted by service area;
(b) are limited to one per person or per venue (as applicable);
(c) cannot be exchanged for cash or transferred to another person or venue;
(d) require a valid Get Dizzy account in good standing (not suspended, terminated, or under investigation);
(e) are subject to availability and may be withdrawn, amended, or paused at any time with reasonable notice, as set out in section 7.
2.2 We reserve the right to withhold, delay, or claw back any promotional benefit if we reasonably believe that the promotion has been abused, that eligibility conditions have not been met in good faith, or that fraudulent activity has occurred. This includes but is not limited to fake referrals, multiple accounts, manipulated engagement, or misrepresentation.
2.3 Unless a promotion states otherwise, promotional benefits may be combined with other active promotions and incentive programmes ("stacking"). For the avoidance of doubt, a Venue Partner may earn benefits under multiple programmes (such as Win a Free Month and Get Dizzy Exclusive Credit) in the same period, and these will be applied cumulatively. We may apply reasonable technical rules to prevent duplicate redemption or unintended double counting.
2.4 Consumer prices are shown as the price payable at checkout (inclusive of any applicable taxes). Venue Partner credit values are stated exclusive of VAT unless otherwise stated.
3. Consumer promotional offers
3.1 Free trial
3.1.1 New consumers subscribing to Get Dizzy+ Monthly receive a 30-day free trial as set out in the Consumer Terms of Service. During the trial, no payment is taken. If the consumer does not cancel before the trial ends, the subscription begins and the standard monthly rate applies.
3.1.2 Free trials are available to new subscribers only. If a consumer has previously held a paid Get Dizzy+ subscription and cancelled, they are not eligible for a subsequent free trial.
3.2 Promotional pricing
3.2.1 We may from time to time offer promotional pricing to consumers, such as discounted rates for early subscribers or special offers for specific service areas. The terms of any promotional pricing will be clearly displayed at the point of subscription.
3.2.2 Promotional pricing is maintained for as long as the consumer maintains a continuous, active subscription. If a promotional subscription is cancelled, the promotional rate cannot be reinstated. Any future subscription will be at the then-current standard rate.
3.3 Consumer Referral Programme
3.3.1 Consumers with an active paid Get Dizzy+ subscription may earn rewards by referring new users to the Platform using their unique referral link, available in their account settings.
3.3.2 A referral is counted only when the referred user creates an account using the referral link and either (a) completes three consecutive months of paid subscription (after any trial or promotional period has ended), or (b) pays for an annual subscription up front. Referrals where the referred user cancels during a trial, promotional period, or before reaching one of these thresholds are not counted.
3.3.3 Consumer referral reward tiers:
(a) 3 counted referrals: 1 month free (applied as a credit to your next billing cycle);
(b) 10 counted referrals: 1 free annual Get Dizzy+ subscription (redeemable as a coupon code at your next billing cycle or renewal).
3.3.4 Referral rewards cannot be earned retrospectively. Only referrals made through the official referral link while the programme is active will be counted.
3.3.5 Credits and coupon codes are single-use, non-transferable, and for use by the referrer only. Expiry dates (if any) will be shown when issued. For annual subscribers, credits are applied at the next renewal. If a counted referral is later refunded or charged back, we may adjust or claw back the corresponding reward under section 2.2.
3.3.6 You must not spam, mislead, or use deceptive methods to generate referrals. Referrals generated through paid advertising, automated tools, or misleading claims about Get Dizzy are not eligible and may result in removal from the programme.
3.3.7 If you share your referral link on social media or other public platforms, you must make it clear that you may receive a benefit if people sign up through your link. For example, you could include "#ad" or "referral link, I get a reward if you sign up" in your post.
4. Venue Partner promotional offers
4.1 Promotional subscription rates
4.1.1 We may from time to time offer promotional subscription rates to new venue partners. Promotional offers may include reduced pricing and/or extended trial periods.
4.1.2 Promotional pricing is maintained for as long as the partner maintains a continuous, active subscription. If a promotional subscription is cancelled, the promotional rate cannot be reinstated. Any future subscription will be at the then-current standard rate.
4.1.3 If a subscription with promotional pricing is cancelled due to non-payment, the promotional rate cannot be reinstated. The partner would need to resubscribe at the then-current standard rate.
4.1.4 Promotional offer availability is at our discretion and may be withdrawn at any time. The terms of any active promotional offer will be clearly displayed at the point of subscription.
5. Win a Free Month (Venue Partners)
5.1 Venue Partners on any subscription tier may earn one month free by completing all five marketing goals within their first 6 months of signing up as a partner.
5.2 The five goals are:
(a) complete the feedback form via the Venue Dashboard;
(b) share Get Dizzy on social media, tagging the Get Dizzy account, and submit a screenshot as evidence via the Venue Dashboard;
(c) submit a testimonial via the Venue Dashboard;
(d) add a Get Dizzy link to the venue's own website and submit the URL for verification via the Venue Dashboard;
(e) run a Get Dizzy Exclusive deal for 90 or more consecutive days.
5.3 Goals (b), (c), and (d) require admin approval based on submitted evidence. We aim to review submissions within a reasonable time. Admin review is for accuracy and appropriateness only; we do not selectively approve only positive content.
5.4 Testimonials submitted under goal (c) may be published on the Get Dizzy website with your permission. We do not require or reward positive feedback. All testimonials must be honest, and we will not publish testimonials that are misleading or that we reasonably consider inappropriate.
5.5 The reward value equals one month's subscription at your then-current rate. Current indicative values are displayed in the Venue Dashboard and will adjust automatically if subscription prices change.
5.6 The credit is applied as a one-off deduction from your next subscription payment after all five goals are confirmed complete. If the credit exceeds your next payment, any remaining balance will be applied to the following payment.
5.7 The 6-month completion window runs from the date your partner account was created. Goals completed after the window has closed will not be counted.

6. Get Dizzy Exclusive Credit (Venue Partners)
6.1 Venue Partners who maintain an active Get Dizzy Exclusive deal for 330 or more days in a 12-month billing cycle may earn a credit equal to 10% of their annual subscription cost, applied at renewal.
6.2 The 12-month billing cycle runs from your subscription billing anniversary. Progress is tracked in the Venue Dashboard.
6.3 The credit equals 10% of your total subscription payments in the qualifying 12-month period. Current indicative values are displayed in the Venue Dashboard and will adjust automatically if subscription prices change.
6.4 The credit is applied automatically at your next renewal after the qualifying period. If you cancel before renewal, the credit is forfeited unless termination was by us without cause.
6.5 "Get Dizzy Exclusive" means a deal that is available only through the Get Dizzy platform and not advertised or available through other channels. The deal must be marked as exclusive using the toggle in the Venue Dashboard.
6.6 Days are counted only while the exclusive deal is live (active and visible to consumers). Paused, draft, or expired deals do not count towards the 330-day threshold.
6.7 The full contractual terms for this programme are set out in section 13.1 of the Venue Partner Terms and Conditions.
7. Changes to promotional programmes
7.1 We may introduce, amend, pause, or discontinue any promotional offer or incentive programme at any time.
7.2 For ongoing incentive programmes (such as Win a Free Month and Get Dizzy Exclusive Credit), we will give reasonable notice before making material changes. What constitutes reasonable notice will depend on the nature of the change, but we will aim to give at least 30 days' notice for changes that reduce benefits.
7.3 If we amend or discontinue a programme, participants who are actively progressing towards a benefit will be given a reasonable opportunity to complete their progress or will receive a proportionate credit reflecting progress to date (as reasonably determined by us using Platform records).
7.4 Changes to promotional programmes do not affect benefits that have already been earned and applied.
7.5 If you cancel a subscription that includes promotional pricing (such as a reduced rate or extended trial), the promotional rate cannot be reinstated upon resubscription. Any future subscription will be at the then-current standard rate. This applies to both voluntary cancellation and cancellation due to non-payment.
8. Optional onboarding service
8.1 We may offer an optional paid onboarding service where we set up a Venue Partner's profile, deals, opening hours, and menu on their behalf. The current price for this service is displayed on the Platform.
8.2 The onboarding service typically includes: setting up your venue profile with the information and images you provide, creating initial deals based on your instructions, and configuring your opening hours and menu. The exact scope will be confirmed before you commit. The service does not include photography, copywriting, menu design, or ongoing management of your listing.
8.3 The onboarding service is entirely optional and is not required to use the Platform.
8.4 To complete the service, the venue must provide the required materials (images, verification details, deal information).
8.5 The onboarding service is non-refundable once the work has been completed and delivered, unless the work fails to meet a reasonable standard of care and skill, in which case we will either rectify the issue or provide an appropriate refund.
8.6 The full contractual terms for optional services are set out in section 15 of the Venue Partner Terms and Conditions.
9. Tax
9.1 Venue Partners are responsible for any tax obligations arising from credits, rewards, or benefits received under these promotional programmes. Subscription credits may need to be accounted for in your business records. We recommend consulting your accountant or tax adviser if you are unsure.
9.2 We do not provide tax advice and nothing in these Marketing Terms should be taken as tax guidance.
10. Geographic availability
10.1 Promotional offers may be limited to specific service areas. Where a promotion is geographically restricted, this will be stated in the offer details.
10.2 As Get Dizzy expands to new service areas, new promotional offers may be introduced for those areas. Existing offers for other areas do not automatically apply to new areas unless expressly stated.
11. Governing law
11.1 These Marketing Terms are governed by the laws of England and Wales. Any disputes are subject to the dispute resolution provisions in your applicable terms of service (the Consumer Terms of Service or the Venue Partner Terms and Conditions).
